ПРАВОВОЕ РЕГУЛИРОВАНИЕ РЕАЛИЗАЦИИ ЭКОЛОГИЧЕСКИХ ПРАВ ГРАЖДАН НА ОСНОВЕ ПРИМЕНЕНИЯ ТЕХНОЛОГИИ «УМНЫЙ ГОРОД»

Abstract

В статье рассматриваются вопросы защиты экологических прав граждан, проживающих в городах, где экологическая обстановка, согласно данным статистики, продолжает ухудшаться. Мировой тенденцией повышения качества жизни людей в городах является реализация концепции Smart City («умный город») как составной части концепции Интернета вещей (Internet of Things - loT). Целью управления Smart City («умный город») становится непрерывное развитие за счет внедрения инноваций в области экологических, экономических и социальных условий жизнедеятельности, что предполагает процессинг новых социокультурных форм жизни города - взаимоотношений органов власти и гражданского общества, деловой среды, а также граждан-жителей. Программа «Цифровая экономика» предусматривает развитие в России 50 «умных городов», в которых будет проживать более трети населения страны. На сегодняшний день не сформирована нормативно-правовая и нормативно-техническая база для развития «умных городов». Новизной результатов исследования является разработка договорного регулирования отношений исполнителей и заказчиков технологий и сервисов «умных городов», в том числе договора информатизации процессов управления. Его предмет составляет осуществление исполнителем действий, направленных на повышение эффективности управления имуществом путем использования информационно-коммуникационных и интеллектуальных технологий, а цена определяется исходя из стоимости сэкономленных затрат на управление муниципальным имуществом. Данный договор предлагается урегулировать как элемент проектирования социально-экономического развития. Предложено доработать Стратегию социально-экономического развития Самарской области на период до 2030 г. и стратегии развития муниципальных образований Самарской области в части включения в них положений о внедрении технологий «умного города». The article deals with the protection of environmental rights of citizens living in cities, where the environmental situation according to statistics continues to deteriorate. The global trend to improve the quality of life of people in cities is the implementation of the concept of “smart city” ( “smart city”) as an integral part of the concept of the Internet of things (lOT). The purpose of Smart City management is continuous development through the introduction of innovations in the field of environmental, economic and social conditions of life, which involves the processing of new socio - cultural forms of life of the city-the relationship of government and civil society, business environment, as well as citizens-residents. The Digital economy program provides for the development of 50 “smart cities” in Russia, where more than a third of the country’s population will live. Today is not the normative-legal and normative-technical base for the development of “smart cities”. The novelty of the research results is the development of contractual regulation of relations between performers and customers of technologies and services of “smart cities”, including the contract of information management processes. Its subject is the implementation by the contractor of actions aimed at improving the efficiency of property management through the use of information and communication and intellectual technologies, and the price is determined based on the cost of savings in the management of municipal property. This agreement is proposed to be regulated as an element of designing social and economic development. It is proposed to finalize the Strategy of socio-economic development of the Samara region for the period up to 2030 and the development strategy of municipalities of the Samara region in terms of including provisions on the introduction of “smart city ” technologies.
